Indecent exposure is a misdemeanor; however, if the defendant makes physical contact with a victim, the act could be labeled "sexual assault" – a second degree felony. The penalties for sexual assault can include prison (between two and 20 years), and fines (up to $10,000).

What are the penalties?

As a Class B misdemeanor, indecent exposure is punishable by fines and incarceration. Sentencing for indecent exposure is at the discretion of the judge, up to a certain amount. The fine can be no more than $2,000 and incarceration in a county jail can last no longer than 180 days.

If the defendant was accused and convicted of a similar offense in the past, he / she may be subject to stricter consequences.
